Privacy Policy

This privacy policy and notice (“Privacy Policy”) discloses the privacy practices of The Holistic District LLC and its mobile application and website (collectively the “Platform”). This Privacy Policy notice applies solely to information collected by the Platform, except where stated otherwise. It will notify you of the following:

  1. Effective Date. The effective date of this Privacy Policy shall be the date of publication on the Platform.
  2. Protected Information. The Holistic District uses commercially practicable means to protect all personal information collected on the Platform from being improperly accessed by third parties at any time. All financial transactions will be conducted through a third party payment vendor on their secure site. Additionally, to the extent that The Holistic District does not foresee a continued use of any such information, it will promptly destroy such information without retaining copies for its files.
  3. User submitted information. The Holistic District is the sole owner of the information collected on the Platform. The Holistic District will only have access to and/or collect information that you voluntarily give it via your user account or other direct contact from you. The Holistic District will not sell or rent this information to anyone. The Holistic District will not share information collected on the Platform with any third party outside of The Holistic District and its agents.
  4. Information Collected Automatically: During your visit to the Platform, it may automatically collect and store the following types of information about your computer and your visit: (i) the domain and host from which you access the Internet; (ii) the Internet address of the website from which you linked directly to the Platform, if applicable; (iii) the date and time you arrived at the Platform and how long you spent on the Platform and which pages you visited; (iv)
    Your Internet protocol (IP) address; and (v) your computer’s operating system and browser software.
  5. Information Collected by The Holistic District. When you sign up for an account with The Holistic District, you give us your name, email address, phone number, date of birth, a copy of your government-issued ID (i.e. your driver’s license, state ID card, or passport), and either your patient number issued by the District of Columbia Alcoholic Beverage and Cannabis Administration (ABCA) or your medical cannabis ID issued by another jurisdiction. In order to receive a delivery, you must provide a valid delivery address within the District of Columbia.
    Such information is a part of what’s called your personally identifiable information (“PII”) as this is data that can be used to specifically identify you. This PII helps The Holistic District establish and maintain your user account, verify your identity, remain compliant with District of Columbia laws and ensure that you are of legal age to purchase medical cannabis.
  6. How The Holistic District uses the Information it Collects. The Holistic District uses the information it collects from you to: (i) identify you as a user in our system; (ii) comply with applicable cannabis and medical cannabis laws in the District of Columbia; (iii) analyze and assess current and potential user markets; (iv) improve, optimize and create new products and services; (v) evaluate third-party partnerships; (vi) personalize your experience with The Holistic District; (vii) provide customer support and assist with your access or use of the Platform; (viii) communicate with you, either directly or through one of our partners, including for marketing and promotional purposes; (ix) facilitate your communication with the driver fulfilling your order; (x) to engage in marketing activities with you and to assess marketing and promotional initiatives; (xi) detect, prevent, or mitigate fraud or any other suspicious activities; (xii) conduct research and development, such as by conducting voluntary user surveys or obtaining other feedback from you; (xiii) create aggregated, de-identified and/or anonymized data, such as for educational content; and (xiv) as otherwise described in this Privacy Policy or in any other notices we have or will provide to you.
  7. How The Holistic District Shares Information with Others. We may hire agents and contractors to perform services on our behalf including, without limitation, facilitating some aspects of our website design, sending emails to you. These third party companies may be supplied with or have access to your personally identifiable information for the purpose of providing these services to us or on our behalf. Agents and contractors of The Holistic District who have access to personally identifiable information are required to protect this information in a manner that is consistent with this Privacy Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for The Holistic District and as otherwise required by law. We may disclose and use your information in special circumstances where we believe in good faith that such disclosures: (i) are required by law; or (ii) will help protect the safety and security of property that belongs to you and/or The Holistic District and its third party partners. In the event that all of our business assets are transferred to or acquired by another company, your information may be one of the transferred assets.
  8. Payment Information. Payment information may be collected in connection with a transaction facilitated by The Holistic District. For products and services, payments may be made directly to The Holistic District or another third party. In all cases, while The Holistic District may retain a limited amount of payment information for identification and convenience, to keep your financial data secure, The Holistic District does not store full payment or financial information on its servers. Unless otherwise noted, payment information flows through a third-party vendor who processes the payments on behalf of The Holistic District.
  9. Cookies. The Platform uses “cookies”. A cookie is a piece of data stored on a website visitor’s hard drive to help us improve your access to the Platform and identify repeat visitors to the Platform. For instance, when The Holistic District uses a cookie to identify you, you would not have to login a password more than once, thereby saving time while on the Platform. Usage of a cookie is in no way linked to any PII on the Platform. The Holistic District has no control over or access to cookies that one of its advertisers may use on the Platform.
  10. Links. The Holistic District’s site may contain links to other sites whose information practices may be different than ours. The Holistic District is not responsible or liable for the information collection practices or content of such linked sites. Visitors should consult the privacy policy of the third party’s site, as we have no control over information that is submitted to, or collected by, these third party sites.

  12. Arbitration. Any dispute, controversy or claim arising out of or relating to this Privacy Policy will be resolved by binding arbitration in the District of Columbia. The Federal Arbitration Act will govern the interpretation and enforcement of this section. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes which are then in effect. Arbitration must be initiated by a party pursuant to AAA rules, which can be found at www.adr.org and will govern how to initiate arbitration proceedings. Judgment upon the award rendered may be entered and enforced in any court of competent jurisdiction.
    YOU ACKNOWLEDGE AND AGREE THAT YOU AND THE HOLISTIC DISTRICT ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
  13. Changes to the Policy. The Holistic District may update this Privacy Policy periodically. If The Holistic District makes any material changes, it will update you on the Platform, by email, or by other communication. The Holistic District encourages you to stay up to date about its privacy practices by reviewing this Privacy Policy periodically. Continued use of The Holistic District following notices of changes to the Privacy Policy indicates your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes.
  14. Age Restrictions. The Platform is intended for access and use by individuals who are of legal age to purchase medical cannabis in the District of Columbia (“Qualifying Age”). The Holistic District does not knowingly collect PII or other information from or about anyone who is not of Qualifying Age. If you are not of Qualifying Age, you should not attempt to access or use The Holistic District’s Platform, or send any information to us. If The Holistic District discovers that it has collected PII or other information from an individual who is not of Qualifying Age, it will take steps to remove that information.
  15. Security. All of the information The Holistic District collects is protected within its database, and The Holistic District is committed to securing your information. Although The Holistic District takes reasonable, industry-standard precautions to protect your information, no security measures are 100% secure, and The Holistic District cannot guarantee the full security of your information. You are also responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails or physical mail between you and The Holistic District at all times. When you direct The Holistic District to share your information with third parties, please note that your privacy and security may also be affected by changes in such third party services. The Holistic District is not responsible for the functionality, privacy, or security measures of any other organization or third party.
